1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Gadgex ("we," "us" or "our"), concerning your access to and use of our mobile application (the "App"). You agree that by accessing the App, you have read, understood, and agreed to be bound by all of these Terms and Conditions.
IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Intellectual Property Rights
Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
3. User Representations
By using the App, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete.
- You will maintain the accuracy of such information and promptly update such registration information as necessary.
- You have the legal capacity and you agree to comply with these Terms and Conditions.
- You will not access the App through automated or non-human means, whether through a bot, script or otherwise.
- You will not use the App for any illegal or unauthorized purpose.
4. Prohibited Activities
You may not access or use the App for any purpose other than that for which we make the App available. The App may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
5. Mobile Application License
Use License
If you access the App via a mobile application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Terms and Conditions.
6. Service Requests and Repairs
When you submit a device for service or repair through Gadgex:
- You acknowledge that diagnosis and repair attempts may void existing manufacturer warranties.
- We are not responsible for data loss. You are strongly encouraged to backup your data before submitting any device for service.
- Quotations provided are estimates and may vary based on actual diagnosis.
- Unclaimed devices left for more than 60 days after service completion notification may be disposed of to recover costs.
7. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the app, even if we have been advised of the possibility of such damages.
